Blogger Found Guilty for Comments Left on Blog
Julio Alonso, owner and writer of one of the most important Spanish marketing blogs: Merodeando.com has been found guilty in the SGAE (the Spanish intellectual property rights watchdog) case against him. The lower court’s ruling sentences Julio Alonso to pay a fine of € 9,000 ($14,000), plus legal fees.
For those of you who are not familiar with this regrettable case, let me just bring you up to date. Our blogger-friend was accused by the SGAE for having attacked its honor. At issue was a series of 22 public comments left on Julio’s blog in 2004. A very unfair accusation since the comments that sparked the lawsuit were not left by the blogger, but rather by visitors to his blog, who, in an attempt to establish an open dialogue between readers, are allowed to leave messages. Julio, in respecting the Spanish legal authorities and out of his own will, edited said comments, replacing “suspicious” phrases with a series of ellipses (…).
This Spanish case brings to mind the French "Fuzz v. Martinez" case, in which the web-platform Fuzz (a French digg-like) lost to Olivier Martinez, Kylie Minogue’s ex-boyfriend. Obviously, the case is not closed; Julio will appeal the judge’s decision. He himself has already made public mention of this.
This brings up a lot of questions for us bloggers: Are we living in an era of intolerance? Will we be judged and held responsible for comments that third parties make on our blogs? Is this verdict meant to serve as an example? And the most important question: What is happening with our freedom of expression in Spain, and in Europe in general?
This is a case that we will certainly be keeping up on because the court’s final decision will have consequences, perhaps negative on the Spanish and European blogosphere.
