eBay: When The Veil Is Lifted...

Posted on December 4, 2009

eBay, the online auction leader, has once again been involved in selling counterfeit products and in unfair competition.

One of their users, a certain "salesnb1" or "bonezef" was anonymously selling counterfeit perfumes from the online selling platform. The problem? Of course the first is that these counterfeit products were sold, but the real issue is that he didn’t supply his real name. eBay asked him for an alias, but it is in fact the responsibility of all online merchants, if they are a physical person, to make sure that the Internet user dealing with them should be able to identify them at any time.

On November 6, the online seller was judged by the Court of Paris for the sale or counterfeit items (items sold in identical and original packaging but costing considerably less), and also for unfair competition (violation of article 19 of the French Law for Trust in the Digital Economy). This is because he managed to make sales without transparency outside the selective distribution circuit chosen by the brands that were concerned. And this isn’t the whole of it! The person hiding behind the "salesnb1" and "bonezef" seller name will have to lift the veil to pay €38,000 in damages to the brands he was counterfeiting.
